Head-line for tomorrow: the four objections Yograj raised on 25-05-2026 were never answered by Seder, and the draft agreement they promised on 21-05 has never arrived. Nothing since 25-05 has touched the terms — only data requests. Do not sign or verbally accept anything until points 1–4 below are settled.
"The agency shall bear full responsibility for the worker during the first six (6) months from the date of employment, including any misconduct, damages, or issues arising from the worker's actions."
Yograj, 20-05 and again 25-05: we guarantee professional efficiency and capability only. Repatriation cost limited to the ticket, plus a free replacement. Personal behaviour and damages of any kind are beyond our purview — the clause should be removed.
Re-draft so Apex's guarantee is limited to competence, skill and licence validity. Misconduct, accidents, traffic fines, cargo or vehicle damage and third-party claims sit with the employer. If they refuse outright, ask for a capped liability figure rather than open-ended exposure.
Probation period is six (6) months from date of employment, with replacement at no additional cost to the First Party. (19-05, 21-05, 24-05)
Yograj, 20-05: industry standard is 3 months / 90 days from the date of deployment — the same term Apex keeps with all its clients.
The Service Charges — Country Wise sheet Apex sent on 29-07 states "3-month probationary period" as the replacement guarantee for every country — India, Pakistan, Bangladesh, Nepal, Sri Lanka. Seder has held that document for six weeks and never objected to it.
Malath's terms table, 24-05, lists working hours as 8 hours in the requirement row — then the criteria underneath state 12 hours per day, 6 days a week, including weekends Thursday to Saturday. No overtime is mentioned anywhere.
Yograj, 25-05: "In the requirement it is mentioned that the working hours are 8, which have been subsequently changed to 12 hours (without OT)." Never answered.
Get one number written into the agreement and into the offer letter the candidate signs. If it is 12 hours, then either OT is paid separately or the basic must rise (point 4). A mismatch here is the single biggest cause of absconding and replacement claims later — and under their own clause those claims land on Apex.
| Monthly orders | Basic | Food | Incentive | Total |
|---|---|---|---|---|
| 350 | 400 | 200 | 400 | 1,000 |
| 400 | 400 | 200 | 1,100 | 1,700 |

| 900 | 400 | 200 | 5,100 | 5,700 |
Yograj, 25-05: preliminary interview feedback from candidates is "less than encouraging". The basic is far too low to attract qualified drivers in volume, especially at 12 hours. The minimum incentive should start at 400 deliveries, not 350.
Apex's own market benchmark — the file Seder asked for and Apex sent on 23-06 — prices "Cars and Trucks Driver" (S.8332) from India at SAR 1,800–1,950 at entry level, and Bus Driver at 1,500–1,750. Seder's HungerStation entry rung pays SAR 1,000. Their own benchmarking exercise proves the package is roughly 800 SAR below the market rate Apex quoted them, for 12-hour days.
"Agency shall bear full cost of this recruitment campaign, including tickets of Seder representatives and deployment of workers."
Yograj, 20-05 offered only: local travel in India, travel between cities and hotel expenses for the delegation. International tickets for Seder's representatives were never agreed.
The 29-07 fee sheet lists the candidate's air ticket (approx. SAR 775) as "Client — billed separately at actual" for India and Sri Lanka. So on the deployment half of that clause Apex has already stated the opposite position in writing, and Seder never came back on it.
Spell it out line by line in the agreement — international air tickets, domestic travel, hotel, ground transport, venue, candidate deployment tickets. Say plainly what Apex covers and what Seder covers. On a 3,000-head campaign, at roughly SAR 775 a ticket, "full cost of deployment" is over SAR 2.3 million of unquantified exposure.
Seder asked on 19-07 for a country-wise breakdown. Apex sent Service Charges — Country Wise.xlsx on 29-07. Seder never replied to it. These are the numbers on their desk:
| Country | Fee / candidate | Lead time | Replacement | Payment terms |
|---|---|---|---|---|
| India — non-management | SAR 1,312 | 45 days | 3 months | 30–45 days of invoice |
| India — management | SAR 1,875 | 45 days | 3 months | 30–45 days of invoice |
| Pakistan — blue collar | SAR 1,000 | 15–21 days | 3 months | 15 working days |
| Pakistan — white collar | SAR 1,120 | 15–21 days | 3 months | 15 working days |
| Bangladesh | SAR 1,136 | 45 days | 3 months | Bank transfer before departure |
| Nepal | SAR 1,316 | 45 days | 3 months | 15 days of invoice |
| Sri Lanka | SAR 1,296 | 45–60 days | 3 months | 30–45 days of invoice |
Not discussed in any email. Seder has been collecting salary benchmarks, SLAs and country-wise fees from "Dear Partners" — plural. Their own words on 19-07: the data is for "internal budgeting, supplier comparison, and future recruitment planning."
Shahad, 19-05: "number of delegates and travel date still TBD, once confirmed we will get back to you." Nearly four months later they still have not. Apex has asked three separate times (18-05, 20-05, 25-05) for the exact India requirement number.

Viz explained on 20-05: Seder must add the visa and Apex details on the Emigrate platform; once the Demand Letter and POA are issued, a signed and stamped copy on Seder letterhead comes to Apex by email. (Apex can do it on their behalf if given the Emigrate login.) Both documents must be issued in the name of Apex Consultants.
Agree a date for the Demand Letter and POA. The number of visas follows directly from the India number in point 8. Nothing moves without these.

Confirm whether Saudi licence conversion, biometrics and the skill test are Seder's or Apex's responsibility. Apex flagged on 11-07 that biometrics and skill-test clearance are two extra stages Seder's own template did not include — get them acknowledged so the SLA is not later measured against a shorter list.
Seder also sent a blank Min–Max salary template on 11-06; the completed version above is what went back. No draft agreement has ever been received — there is no contract file to review before the meeting.
| Name | Role | Where they appear |
|---|---|---|
| Shahad Bathabet | International Recruitment Assistant | Main coordinator throughout · called this meeting · sent both condition emails |
| Naif Yahya Alshehri | — | New name — appears only on the meeting invite. Likely the decision-maker |
| Norah Al-Ammar | Talent Acquisition Manager (Acting) | Received Yograj's terms · routed everything sideways instead of answering |
| Malath Nawaf Alshalan | — | Sent the full terms and salary grid, 24-05 |
| Reem Alhalafi | Talent Acquisition Specialist | Salary benchmark request, June |
| Abdulaziz Fayez Alamri | — | SLA and country-wise cost requests, July |
| Abdullah Alshahry | — | CC on nearly every thread, start to finish |
| Yasser Alshakweer | — | CC from 19-07 onward |
Six different people have written on terms, and Yograj's four objections were passed sideways — Norah to Malath, then Norah to Reem — rather than answered by anyone. Ask at the start who actually owns sign-off, so the answers do not disappear again.
